About these terms

These Terms and Conditions apply when you use our website or purchase products directly from SAMA as a consumer.

Please read them alongside our:

  • Privacy Policy;
  • Returns and Refunds Policy; and
  • Shipping Policy.

Nothing in these terms affects your statutory consumer rights.

References to "SAMA", "we", "us" or "our" mean Georgina Clements trading as SAMA.

References to "you" or "your" mean the customer or website user.

Our products

We take reasonable care to ensure that product descriptions, photographs, measurements and prices are accurate.

However:

  • product images are for illustration;
  • colours may appear differently depending on your screen, device and lighting;
  • measurements and weights may be approximate;
  • minor variations in colour, finish or texture may occur during manufacturing; and
  • packaging may differ from that shown online.

These variations do not affect your rights where a product is faulty or materially different from its description.

Product availability

Products are subject to availability. Placing a product in your shopping basket does not reserve it.

If a product becomes unavailable after you place an order, we will contact you and refund any amount paid for the unavailable product.

We may limit order quantities where reasonably necessary to manage stock, ensure fair access to limited releases or prevent unauthorised resale.

Placing an order

The Shopify checkout allows you to review your order before submitting it.

When you select the final payment button, you are offering to purchase the products in your basket under these terms.

You will normally receive an email acknowledging that your order has been received. This acknowledgement does not necessarily mean that we have accepted your order.

A binding contract is formed when we send confirmation that your order has been accepted or dispatched.

Please check your order and delivery details carefully before paying. Contact us promptly if you notice an error. We cannot guarantee that an order can be changed once it has been processed or prepared for dispatch.

When we may refuse or cancel an order

We may refuse or cancel an order where:

  • a product is unavailable;
  • payment cannot be authorised;
  • billing or delivery information is incomplete or inaccurate;
  • we cannot deliver to the address provided;
  • there is an obvious pricing or product-description error;
  • an order exceeds a stated quantity limit;
  • we reasonably suspect fraud or unauthorised resale;
  • these terms have been seriously breached; or
  • we are legally unable to complete the order.

If payment has already been taken for an order we cannot accept, we will refund the relevant amount using the original payment method.

Prices

Prices are displayed in pounds sterling and include VAT where applicable.

Delivery charges and any other applicable costs will be shown before you complete checkout.

We may change our prices at any time, but price changes will not affect orders that have already been accepted.

If we discover an obvious pricing error before accepting your order, we may offer you the option to purchase at the correct price or cancel the order for a refund.

We are not required to supply a product at an obviously incorrect price where the error could reasonably have been recognised.

Payment

Available payment methods are displayed at Shopify checkout.

Payment may be taken when you submit your order, including for pre-order products. Taking payment does not by itself mean that we have accepted the order.

Payments are processed securely through Shopify and the relevant payment provider. We do not normally receive or store your complete card details.

You confirm that the payment information provided is correct and that you are authorised to use the selected payment method.

Pre-orders

Products marked as pre-orders are not available for immediate dispatch.

Any expected release, dispatch or delivery date shown for a pre-order is an estimate unless we expressly confirm that a particular date is guaranteed.

Estimated dates may be affected by manufacturing, freight, customs, supplier delays or other circumstances outside our reasonable control.

We will contact you if we become aware of a significant delay. Where a revised estimated date is materially later than the original date, you may cancel the affected pre-order before dispatch and receive a refund.

If your order contains both available and pre-order products, they may be dispatched together when everything is available or sent separately.

Your statutory cancellation and consumer rights continue to apply to pre-orders.

Delivery

We currently deliver to the locations available at checkout.

Orders are usually processed and dispatched within 2–3 working days. Standard UK delivery usually takes a further 2–4 working days.

Please allow approximately 4–7 working days from placing your order for it to arrive.

Delivery charges, estimated delivery periods and further information are provided in our Shipping Policy and at checkout.

Unless another delivery period has been agreed, we will deliver your order without undue delay and normally no later than 30 days after the contract is formed.

You are responsible for providing a complete and accurate delivery address.

A product becomes your responsibility when it is delivered to you, a person nominated by you or a safe place expressly authorised by you.

Cancellations, returns and refunds

Your cancellation, return and refund rights are explained in our Returns and Refunds Policy.

For most products purchased online, you may tell us that you have changed your mind within 14 days after receiving the product. You must then return it within a further 14 days.

Unless a product is faulty, damaged, incorrect or not as described, you are normally responsible for the direct cost of returning it.

Faulty, damaged or incorrect products

We are legally responsible for supplying products that are:

  • of satisfactory quality;
  • fit for their normal purpose;
  • fit for any particular purpose agreed with us; and
  • as described.

Contact info@samacollective.uk if a product arrives damaged, is faulty, is incorrect or is materially different from its description.

Depending on the circumstances, you may be entitled to a refund, repair, replacement or price reduction.

Your statutory rights are not limited by these terms or by our Returns and Refunds Policy.

Product care and use

Please follow any care, cleaning, storage and usage instructions provided with the product or displayed on our website.

Normal wear and tear, accidental damage, misuse, improper storage or failure to follow reasonable care instructions will not normally constitute a fault.

SAMA products are movement and lifestyle products. They do not provide medical advice or guarantee that a particular activity is suitable for you.

You are responsible for deciding whether an activity is appropriate for your health, experience and circumstances. Seek appropriate professional advice where necessary.

Nothing in this section limits responsibility where doing so would be unlawful.

Promotions and discount codes

Promotions and discount codes may be subject to additional conditions displayed when they are offered.

Unless stated otherwise:

  • codes must be entered before payment;
  • only one code may be used per order;
  • codes cannot be exchanged for cash;
  • codes cannot be applied retrospectively;
  • product exclusions or minimum spending requirements may apply; and
  • codes may have an expiry date.

We may refuse a discount where a code has been used fraudulently, without authorisation or contrary to its conditions.

Intellectual property

The SAMA name, logo, product designs, patterns, photographs, videos, graphics, written content and website materials are owned by or licensed to SAMA.

You may use our website for personal, non-commercial purposes.

You must not copy, reproduce, modify, distribute, sell or commercially use our content or designs without prior written permission.

Purchasing a product does not transfer ownership of any intellectual-property rights in its design or branding.

Acceptable website use

You must not:

  • use the website unlawfully or fraudulently;
  • interfere with its operation or security;
  • introduce viruses or harmful code;
  • attempt to gain unauthorised access;
  • impersonate another person;
  • provide false or misleading information; or
  • scrape or commercially reproduce website content without permission.

We may restrict access where reasonably necessary to protect SAMA, our customers or the website.

Our responsibility

We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Products sold under these consumer terms are intended for personal use. We are not responsible for business losses, including loss of profit, revenue, opportunity or business interruption.

Nothing in these terms excludes or limits responsibility where doing so would be unlawful, including responsibility for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • defective products where liability cannot legally be excluded; or
  • breach of your statutory consumer rights.

Circumstances outside our control

We are not responsible for delays or failures caused by circumstances outside our reasonable control, including severe weather, courier disruption, strikes, supplier delays, customs delays or failures of payment or telecommunications systems.

We will take reasonable steps to minimise the effect and contact you where your order is significantly affected.

This section does not affect your statutory rights, including your rights where delivery is substantially delayed.

Complaints

Please send complaints to info@samacollective.uk and include your name, order number and a description of the issue.

We will investigate complaints fairly and respond within a reasonable period.

This complaints process does not affect your statutory rights.

Governing law and courts

These terms and any contract between you and SAMA are governed by the laws of England and Wales.

If you live in England or Wales, proceedings may be brought in the courts of England and Wales.

If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts where you live.

You continue to benefit from any mandatory consumer protections that apply where you live.
